Hi, I am US citizen recently engaged(Not married) to an Indian gal while I was
visiting India. Not to boast but I officially have pictures to prove it if INS
asks for it.

Anyway Here are my questions please clarifiy. Can some one clarify wat all I need to
file and where in USA so that she can apply for a K3 visa when we officially get
married in a year or so. She does not have a passport yet, just applied and probably
it would take a good two to three months to get it in India. Meanwhile can I petition
her in the USA??. Do I need to wait until we get married??. My understanding is I can
petition(I-130) for her in the USA, then go ahead and marry her in India and then
apply K3 visa for her at Chennai, India. Please clarifiy wat would be the best path
to take and how. I am really lost in the jungle....

You can petition for a fiance and then marry after her entry, but in order to
petition for a K3 (spouse visa early entry) you must FIRST be legally married,
because a certified copy of the marriage certificate will have to be filed with the
I-130 petition.

If you do marry in India legally, then you would first file an I-130 petitiion to the
US service center and THEN after you have a notice of receipt, you would file an
I-129f form for the K3 visa for her.

Many people know more about the K3 than I do so I will let others answer that but...

You need a marriage certificate to file the I-130, so you need to get married BEFORE
you file that. You can get the paperwork together earlier but can't send it in
without a marriage certificate.

Just because I wasn't sure exactly what he was asking -

You can't send in the I-130 and then go ahead and get married, as you've worded it -
you need to be married first, and then you can file the I-130.
