K3 time estimate for Californian marrying South African abroad
Hi All,
Firstly, great newsgroup. There is a wealth of info here. I hope to
contribute myself in future.
I am South African and my Californian fiancee and I are planning on
getting married in South Africa. A San Diego based law firm claims
they can have us both in the USA within 2.5 months after getting
married with me on a K-3 visa. We have grilled them over the phone,
and their story does not have any holes in it. They have also been in
business for about 13 years. In your experience, is this possible, or
does it sound too optimistic?

Are they willing to put it in writing?
Then you will know if the story has holes in it..........

Are they willing to put it in writing?
Then you will know if the story has holes in it..........

Anything is possible. We don't know any of the details much less all of them. Are they willing to refund say $10.00 dollars per day for any time over runs? Thirteen years means little. Ask for some references. Five people in your similar situatiion that you may speak to. Yadda Yadda Yadda...Sounds like BS to me.

Except for a "premium processing" case [not available for "K" visas], you can't "guarantee" any particular time frame.
One of my early cases involved a guy filing two I-130's for his identical twin daughters. The applications were indentical in all respects -- filed at the same time in the same office by the same lawyer -- one was approved in 21 days and daughter immigrated 3 months later. The other petition took 9 months.

It sounds awfully optimistic to me. You can see the processing dates
for the K-3 I-129F forms at
https://egov.immigration.gov/cris/js...ocesstimes.jsp
They're currently working on forms that were filed January 27,
over three months ago. That single step of getting the I-129F
approved is taking longer than 2.5 months, and that's only one
part of the process. You have to wait around two to three weeks
after the marriage before you can file the I-129F (because you need
to file the I-130 and get the receipt, which will take a week or
two, plus you need the marriage certificate to be recorded, etc.)
After the I-129F is approved, there's still a multi-week process
to get the forms to the consulate, schedule an interview, and get
the visa.
I don't see how anyone, even under the best of circumstances with lots
of good luck on their side, could get a K-3 visa much less than four
months after their wedding, given the current processing timelines.
And nobody can predict when the USCIS will delay a case for whatever
reason.
I wouldn't trust my fate to a lawyer that makes such outrageous
promises. But it might be fun see their reaction if you ask for
a guarantee in writing, with, say a 10% of the fee to be refunded
for each week delay. If they take more than double the time they
promise, they'll end up paying you!
