This might sound dopey, but when filing for the K3 visa and K4, for my husband and his son, am I right to assume that they should be granted it at the same time? He has full custody.
Just curious.
Just curious.

That depends. Are they applying for the visa at the same time?
ALso, "full custody" does not always equate to the unequivocal right
to move the child out of the country. In fact, there was a recent court
case in which the mother loss "full custody" because she moved her
children out of state.

We are having documentation written up by a solicitor that states her permission for the boy to move to the US. She has not been in his life for the past 4 years, and has no problem with her son coming over here.
