K3/AOS

Default K3/AOS

A BCIS customer service operator told me that as a k3 visa hold, my
wife that is, we are not to file for AOS until the I 130 is approved.
Well, I am part of an egroup where I have noticed some people have
filed AOS while on k3. One moderator told me they are california and
their Spouse visas were approved. But other people whose visa arent
yet filed AOS anyway.

Should I file for AOS anyway? My wifes k3 visa expires in Sept as
well as the EAD. the I 130 is dated march 2001 through TSC. Should
I file AOS anyway or wait? Right now my mentality is to file. Worst
thing that could happen is it get sent back?

Hey John!

Does your local office allow AOS without an approved I-130?
If so.. do it!!

You need to find out whether your local office allows AOS before approval. California does.


I did read somewhere that it was intended that K3's would apply for AOS rather than wait for I-130's.
