K3 -- Adjustment of Status required or not?
 

Hello

the INS/BCIS is not giving me a straight answer.

Everytime I call, they either tell me

"Yes, your wife DOES need to apply for adjustment of status in order for the I-130 to be processed/approved".

Then the next time I call

"no, your wife DOES NOT need to apply for adjustment of status as she already has her visa and her 1-130 is submitted"

I have spoken to everyone from operators to supervisors to officers.

has anyone here gone thru the same problem? I am very worried that her green card will be forgotten.

You have two options
 

1)File for AOS
2)Wait for the I-130 to be approved, and then travel back to your country where you will be processed. you then return to the States as a permanent resident.

It may be easier if you go the AOS root.
