K2 problem; exhusband permission for kids to emigrate!

O.K. Here is my problem: My fiancee is a very nice russian woman with
two young daughters who are minors. 5 years ago, she fled back to
russia with her kids to get away from her abusive moslem husband in a
middle east country. She does not have any real "custody" papers for
them, but she has them listed in her passport and is free to travel
with them to other countries and has done so often. Currently, she
has a divorce paper that basically annuls/voids her moslem religious
marriage, which occured in Moscow; this divorce means she is free to
be married and so we can apply for our K1 visa for her. Now our
problem may become the K2s for her daughters.....
I have heard that during US embassy interview in Moscow, that the US
embassy normally requests some information from the exhusband to give
permission for the kids to immigrate to the U.S. I am doubtful that
the exhusband will be very cooperative, and so do not think we can get
his authorization for the children to permanently leave russia for the
U.S. Is this true requirement for K2 visas or is there any way
around this problem? Also under what scenarios is it possible for her
to bring the kids without her husbands permission(i.e. abuse or some
other reason?) We just started the I129F paperwork, so I'm trying to
solve our problems here proactively, as this will probably come up in
about 6 to 8 months at her interview. So anything we can do now to
get started solving this will save us later. Thanks for all your help
and advice in advance!

Your question is one for an attorney. What State do you live in?
I know here in Okla. the State can take your children away from you if your deamed an abusive parent.

This really doesn't apply because neither one of the parents are currently living in the US. This only applies to American citizens and residents.
The OP is in a difficult situation if the father does not want to cooperate. Middle Eastern laws tend to favor the father first and foremost.
