K1 w/ AP Travel Question
All
Does a K1 Visa and Advanced Parole open the same doors as a US Passport? My fiancee
(soon to be wife is from Russia and under normal circumstances could not get a visa
to Canada, or travel to Europe without a visa (like USC can). I frequently travel to
Canada and would like her to join me on these trips. If K1 holders are not granted
the same travel freedom as passport holders do we have to apply for visa as if she
were a Russian citizen? All advise. opinions, questions and comments are appreciated.
BTW we just received a July 9 interview date in Moscow... They received i129f
petition May 6.

First of all, the K-1 visa is a United States visa only good for one entry into the
US. Then you have 90 days to get married and file for Adjustment of Status. Having a
US K-1 visa in your passport is completely meaningless to any other country. Once AOS
is filed, you new wife is not in K-1 status, but has status as an immigrant awaiting
adjustment. Along with her AOS paperwork, she can file for Advance Parole and an EAD
card. Advance Parole does not allow an intending US immigrant the ability to travel,
it allows him/her to return to the US and not fall out of status that is based on
his/her pending AOS application when traveling. Again, no other country will care if
your wife has an AP document. Once your wife is a Permanent Resident, she would be
able to travel to Canada, Mexico or Switzerland without a visa (just her Green Card),
but other than that she will have to get whatever visas are required of Russian
citizens to travel to whichever country you are going to. Take Care. Shelley

Just to add to what Shelley said. Although her having AP won't enable her to travel
visa free to certain countries, the fact that she is living in the US with a US
husband may enable her to get visas that she would have been denied as a single
female applying from Russia.

Andy,
Is it true that when you have your GC (hopefully I'll get mine next year) that you
'use' it as a passport ? I thought your GC is only for re-entry to the USA. Not
for I.D. use to get into other countries. Like an AP while you are in AOS.
Permanent Residents are not allowed to get a passport right ? Only a USC's can get
a passport right?

No. This is not true. It is more like a visa that you need to show airlines in some
countries before they let you on a plane to the US.
It can also helpful to be a permanent US resident if you are trying to get a visa to
another country.

Sorry.. I missed the original post...
I don't think AP would carry the same weight for a Russian in getting a visa as a
green card would, but you might try. We haven't had that experience since my wife
entered as a PR, but the lady at the Dutch Consulate did express doubt about
accepting the INS extension letter after we filed I-751 for removal of conditions.
The web site says they do NOT accept VISA extension letters. I explained this wasn't
a visa extension letter, but a residency extension.

I'm not 100% on this but I believe it depends where you are going. If I'm returning
to the UK for a trip obviously I need my passport. If I'm travelling to Canada I am
led to believe that I would not need a passport but I would take one anyway.
