K1 vs. I-130 - Canadian/American Marriage... Which is better.
Hi everyone...
I've been receiving conflicting information on which would be the best way from my
fiancé and I to proceed.
Two lawyers have told us that getting married in the US (our eventual home together)
would be the best bet and then filing a I-130. However I've just been told by a
friend and another lawyer that filing for a K1 while my fiancé remains in Canada
would be the best way to go as the INS really frowns upon marriages taking place in
the US in such circumstances...
HELP which do we do?

Either way is fine - my husband (former fiancé from Manitoba) and I went the K-1 visa
route, but many Canadian fiancés have entered the US as a tourist, waited about 60
days, then married and filed the I-130/I-485 package. See www.k1faq.com for details

Either way you can get a green card for your girlfriend, but the difference is the
time. I recommend you K-1 since that’s the easiest way. Good luck!
