Hi All:

My fiance had her visa from the Ghana, consulate on 03-05-04.
She had everything from me for the interview and so it was very
straight forward one. she was asked about two questions and that was
it.

she is expected to arrive in New york on the 6th of april. we are
getting married a day after.

I just lost my job ( actually laid off) and so my question is can i
apply for employment authorization for her immediately we get married
even before we apply for AOS??
I might not do that though but is it possible.????

I assume since she is arriving in New York that she will be flying into JFK. If so, the chances are good she will get the work authorized stamp in her passport which will be good for the duration of her K-1 visa ... 90 days. She cannot get the one year EAD until she has applied for AOS and has a basis for eligibility.

The next rung on the ladder to employment is the social security number. As a K-1, again she is eligible. If you live in Brooklyn, you HAVE to use the Brooklyn SSA office. If you live in any of the other boroughs of NYC, you are free to use any SSA office you wish. The trick is to have her name appear on the SAVE system to avoid delays in the issuance of the SS number. Give it about a week before she goes into apply for the SS number.

Here's hoping you find employment before she arrives or at least have applied for unemployment benefits and/or have a co-sponsor so she can apply for AOS asap.
