K1 Visa Denied and maybe getting worse!
#16
This poster originally filed for the I-129F. His fiancee was found ineligible because of her working as a bar girl. Rather than just filing for a waiver for the I-129F, he turned around and married her in her country. Now he is wondering whether he should hide the marriage and continue with the waiver for the I-129F or go the I-130 route and get the waiver for that visa instead.
As for judging the validity of the marriage, that is standard whether the foreign spouse is in this country or in theirs. Why do you think you have to supply documentation supporting the fact that you are a married couple. Of course, if you have never lived together as husband and wife it is difficult to prove anything but that you have a relationship based on trips to one another, phone calls, mail, e-mail, support checks, etc. YOu can't just marry someone and expect the US Consulate or the INS to say "That's nice. Here's your green card."
