K1 and previous POE denial

Default K1 and previous POE denial

Hi everyone..
1st Post so please be gentle with me :-)
I attempted to enter the USA at the beginning of September on the UK/USA
Visa waiver plan.. I was asked the usual questions at the initial booth and
one answer I gave made the officer decide to send me for futher
questioning.. The result was I was refused entry and volutarily returned
home..

We have filed for K1 fiancee and have sent in the I129F to Vermont.. which
has been recieved and we are told the receipt is in the post..

My Question is.. has anyone with a previous refusal on their passport, had
any problems when applying for a K1..
The original POE was detroit..

what did you tell them? you were comming to the US to blow up buildings? or
you were comming to try and get the US government to support you and collect
as much as you can from any handout programs you could get on? I am curious
because I have not heard of a UK person being turned away before.

Hi Brent. Nothing more sinister than telling them I was to be there for 3 months to aid my Gilrfriend who runs a daycare to look after HER kids while she had an op on her wrists. Not to work in the daycare.. But the POE officer decided that I was there to work and therefore I needed a work related Visa and told me I could either return voluntarily there and then or see a judge and risk deportation and banning. So It turned out to be a very expensive day trip to Detroit to see part of the inside of the airport. My luggage actually made it further into the USA than I did. :-(..
They wrote in TWICE in the passport that I was refused entry with the sections of the act I think,. I need to check those to see what they were saying..

Hopefully it will have no effect on the K1 as they will see this is a legitimate entry with the loads of evidence we have.

My husband was denied entry, before he was my husband, when coming to visit me in December 2000. We did have a six week delay on the K-1 on his side in the UK, because his fingerprint check came back with a positive, which meant they had to double check back here in the States. However he did interview successfully in London for his K-1 Visa. If you do a search on this newsgroup you will see information on this. Good luck!

I don't think you have a problem because you were just not allowed to enter,
because you had the wrong visa in their opinion. that's different than
applying for a visa and being denied for some reason.

and I was just kidding about the blowing up the building thing. :-)

Hi all, I'm Brazilian and I've been refused admission as well once. It
happened that I spent 12 months with a B-2 visa (had extension
granted), left to visit my home country and tied to get back. But I
was working as a nanny and they asked me if I wanted to leave
voluntarily or be officially deported. Of course I left, but I was
also handcuffed and put in a "facility center" until the time of my
flight back home. Maybe me, a tiny girl, was going to run away from 2
huge INS officers...
Now my USC fiance is worried I can be denied the K1 visa. My passport
has a cancelled visa and a lot of stamps with "withdrawn".

Will that affect the K1 process?

Hello,

Sorry to hear what happened to you. I have entered the US about a
dozen times through Detroit, and sometimes they can be a handful.

Regarding the fact that the officer thought that you needed a work
authorization. The officer probably just get stuck on the working at
the day care idea. Once they are stuck on an idea, they won't get out
of it, and whatever you are doing to try straightening out the
situation just doesn't work. I have seeing that several times. I have
in my passport 2 expired J1 visas, and even when you hand them advance
parole documents, they still flip through your passport and got
totally confused (because at the time one of my J1 was still valid). I
have had some really hard times explaining that I am not on a J1
anymore.
