Default K1 and a college student.

Hi all ,

I am a college student that met my fiance last semester. We have
grown really close and we are starting to look at other options. She
is a Canadian citizen whom just graduated from college in the states
and we have really been racking our brain on how to proceed from here.
The main question I am having is about sponsorship. As I am a
student how would I proceed with sponsorship? Could I have a
co-sponsor? If so, what are the requirements for a co-sponsor? Also,
can my fiance work while filing the K1? Thanks for any help you can
give me. I am trying to sort all of this out before we decide what
route to take.

Yes, you can have a co-sponsor. In order to show you can support her you must be at 125% over the poverty line. That means for a 2 person household you have to make approx. $15,150 a year. But, as said before you can have a co-sponsor. You would have to file two affidavit's of support. The first when you apply for the K1 visa, the second after you get married when you apply for adjustment of status. The second one is more "hardcore" and will make you and your co-sponsor responsible for your new wife until she either becomes naturalized, or uhmm....I can't precisely remember the other options....I think the others are something like she has to work a certain amount of time (don't quote me on that....download I-864 for the details). Your fiance might, or might not be able to work depending on the port of entry. Apparently JFK is the only (or one of the only) POE that will hand out EAD stamps for K1's anymore. If she doesn't get that then she would have to wait until you get married to apply for her EAD. It can take several months for her to receive the card depending on where you live and what office you go through. Let me just say that I'm here in Atlanta and got married September 10th, sent my EAD forms off at the end of September and I'm probably looking at another another couple of months before I get mine. But like I said before, it all also depends on what office you go through.

Requirements for co-sponsor are the same as a sponsor.
125% of minimum income for the number of people in the household + 1.

K1 is not difficult but it is lengthy. I would look into DCF maybe. I don't
know about Canadian DCF but it is a shorter process, or it is supposed to
be.

Just check everything out for yourself and always check with the consulate
you are using.

Hi Rick:

You say your fiance "just graduated". Where is she NOW -- US or Canada? When do you plan to marry? If she was here on an F-1 admission [no "visa" inasmuch as she was Canadian], there is a 60 day grace period of lawful status after graduation?

There are a lot of facts you do NOT give that may influence your course of action.

On the sponsor end of things, you will probably need a co-sponsor here. Also, how close are you to graduation and perhaps getting employment? That can influence things also.

You might want to consult with an immigration attorney on this. [I said "consult" -- you just may end up doing it yourself].

There may be options you are not aware of. And an NG discussion is not the best way to ascertain them.

There is no Canadian DCF. While other countries have sometimes suspended visa services temporarily, Canada has for several years been the only country to not offer DCF for either resident or non-resident USCs.
