Honestly I didn't expect so many replies as a rookie member. Thanks. I
have been doing legal research online for quite a long time and I have
to say that you are right. The pending adjustment status is designed to
prevent us from receiving benefits including in-state tuition. But now I
am facing a weird situation. The community college who has granted me
in-state status now backed off. I have not been notified of anything yet
but they have changed my status to out-of-state on webpage. They did not
explain why they said their policy is more lenient couple of days so I
got it just days ago and now maybe they shouldn't have been lenient. Not
a word. I am not kicked out of class but I doubt if I would get my
credits if I refuse to pay. I am so distressed and a little bit
distraught. I think I will try to work out a deal with college that I
will give up on appeal with state university so they will be out of
trouble and exempt my backpay. Guys, what do you think? Shall I roll
with punches or be tough and bluff them out? Wish you all good luck!

Each state is different. I had a case recently where son started community college shortly after immigrating with his parents. His parents thereafter abandoned their LPR [this was a legal "parachute" scheme, but I digress]. Note that my client HAD LPR status. He was later changed from "new resident" subject to out-of-state "tuition" under California law to "resident" exempt from "tuition." ["Tuition" is in quotes becase Calif. always charged "fees" which used to be nominal and are now equivalent to "tuition" in many colleges -- but still "tuition-free."].
Well, he transfers from Community College to University of California, and UC classifies him as "non-resident" becuase he was not emancipated from his parents, who had abandoned LPR status and lived outside of the country.
They both followed the SAME law, but UC interpreted it differently. And it wasn't worth it to litigate.
