k1 adjustment
 
Afternoon everyone. so on February 14th i got married to my lovely fiancee and on Saturday we are gonna send of our change of status paper work, here's a list of what Im sending just to double check i've got everything. let me know if im missing something.

I-485
Passport photo copies (visa page copied)
2 photographs
I-94
G-325a (do i only send on my behalf) or does my wife need to send one?
I-864 Affadavit
Marriage license copy
I-75
I-131 advance parole
Vaccination report
Birth certificate

Congratulations on your marriage! :) You're sending an "Adjustment of Status" package...not a Change of Status. When it comes to immigration, those are two different things.

I-864 Affidavit
Affidavit of Support. Make sure your wife also provided the required backup documents for that (most recent tax return, proof of US citizenship, proof of current income if different from last tax return).


Marriage license copy
No. Not the marriage license. You need a photocopy of the "certified copy of the marriage certificate".


I-75
I assume you mean I-765 for EAD?


Vaccination report
Is this a copy of the one you got at your overseas medical, or something you got from a US civil surgeon signing off on your vaccination record?

Just make sure you have all the backup documents required for the I-765 and I-131 also, since you didn't break those down any further in your list.

I also assume you're attaching a check for the correct fee.

Remember to keep a photocopy for yourself of this ENTIRE package. Be sure to send it out via a trackable method.

My birth certificate is a copy. As for the vaccination report it is the one i got in the UK from the doctor i had my visa medical with. What extra paperwork do i need to send with the I-765 and I-131. as for the affidavit my wife is sending her last 3 years tax forms off. PS i found the pettion certificate. i meant my marriage cert not license sorry.

You might be OK just showing that, or you might get an RFE asking you to get it "transcribed" onto the I-693 (?) form by a US civil surgeon. I've seen it work both ways. Depends on the Officer who reviews your AOS package.

Go to www.usics.gov, Forms, and read the instructions for the I-765 and I-131. They each have some backup documents required...such as passport-style photos, copy of your I-94, etc. Just follow the instructions for each, and include what is required.

Plus proof of her US citizenship, right?

ive got I-94 and passport pictures included already. photo copies of her passport will do right? ill have a read over the form instructions

You mentioned you included them, but I wasn't sure if that was only for the I-485, or if that was also for the I-131 and I-765. Each application needs its own set of photos and I-94 copy. Since you only mentioned 2 passport photos, I figured you hadn't included the ones required for the I-131 and I-765. But if you meant "2 passport photos for each application", then you're fine.

Are you looking at Pages 6 and 7 of the I-765 instructions, here: http://www.uscis.gov/sites/default/f...-765instr.pdf?

It says if filing in category (c)(9), which you are, you don't need an I-94 copy (so I was wrong on that point), but it also clearly says you need 2 passport style photos (page 7). And, as you say, a copy of your passport as ID.

Make sure you read the I-131 instructions also, here: http://www.uscis.gov/sites/default/f...i-131instr.pdf. It clearly says on Page 9 that two passport style photos are required.

As a K-1 visa holder, you are eligible to work your first 90 days in the USA. However, you don't have any proof of this eligibility, so if an employer wants you to complete an I-9 form, you won't be able to, and probably won't get hired.

It takes between 60 - 90 days to get your EAD in hand after filing AOS, if there are no RFEs involved.

This is what I'm trying to tell you.

It's 2 photos PER APPLICATION.

2 photos for the I-485. 2 photos for the I-765. 2 photos for the I-131.

Attach 2 photos to EACH application.

You will lay out 6 passport photos in front of you. You will put 2 photos in the I-485 envelope. You will put 2 photos in the I-765 envelope. You will put 2 photos in the I-131 envelope. Then you will put all that into one larger envelope for mailing.

BTW, on the I-864, the Government insists that the regulations require the form for a K-1/2 adjustment. However, no one seems to have seen the regulations. When AILA liaison asks about that, the CIS people just say they disagree that the regulations do not require an I-864. They still refuse to disclose how they come to the conclusion that an I-864 is required.
