Hello !

does anybody know whether you can get work authorization with the new K-3 visa ? I
mean - somebody files the I-130 and then - relatively soon after the wedding - they
decide to take the K-3 road. The original I-130 might take 1 1/2 years or even longer
to process. Will the spouse be able to work during that time ?

Yes, the recipient of a k-3 or k-4 visa is eligible for work authorization. Of
course, he/she will have to convince the SS office of that and obtain a SS card
before actually starting to work, and will have to obtain an EAD from the local

My fiancee called the INS service hotline yesterday and they informed her that work
authorization is NOT included in the new K3 visa. I think that since this Visa is
brandnew that they have no real clue what they are talking about yet. I mean - if you
can work on a K1 visa then why not on a K3 ? I don't understand this.....

Can anybody confirm ?

The K-1 only allows you to work for 90 days. You have to then apply for a one year work permit at the time you file for your adjustment of status.

With the K-3, I don't think everything is in place yet and the 1-800 number is notorious for incorrect answers.
