K-3 visa only if spouse is in US?

I assumed that anyone could apply for the K-3 visa is your spouse is a US citizen.
Now I read that this isn't so? Does anyone know for sure? I know it states that
it's to make the process faster so families can be together but when I read the
requirements, it doesn't state that the US citizen must be living there. maybe I'm
only reading what I want it to say!LOL any input before I send the I-130 off?

and http://www.shusterman.com detail the K-3. Regardless of residency, you can't apply for the K-3 until you have the first NOA from the filing of the I-130. Therefore, why are you hesitating in filing?
