k-2 visa question

Default k-2 visa question

My Thai wife has a 4 year old daughter who we mentioned in the original
application for the K1. My wife finally got her permanent resident card
(Hurray) today, January 31, 2004.

The question to the newsgroup is this:

1) Can we still, hopefully, get the daughter in on a k-2, even though its
more than 1 year since the issuing of the K-1? (Issued May, 2002)

2) How do you change the name on the Permanent Resident card to reflect that
her last name is now my last name?

1) Not to my knowledge. Maybe a call or visit to the embassy would be in order to check, but my understanding was that the K-2 application had to be initiated within 1 year of the issuance of the K-1. You do have the option of filing an I -130 for an immigrant visa for the child, though. That is filed through your Service Center, but consular processing for the visa requires an I864 instead of an I134 for an affadavit of support.

2)I have no idea how to change the last name.

I mean should we even try with K-2? Or just go ahead with the I-130? That
could mean years doesn't it?

You would be denied the K2 as it wasn't applied for within the relevant timeframe. The I-130 is the only route open to you. You should ask, when you file the I-130, how long it will take.

Peter,

1) No.

2) If your wife was going to adopt your surname, why didn't she apply for AOS in that name in the first place? Anyway, since she didn't, why bother now - take care of it when she applies to remove conditions.
