k-2 visa question

Default k-2 visa question

Hi all,

My Thai wife who entered the us on a k-1 (ISSUED MAY 20,2002) has a child,
whom we would like to bring to the U.S.

The child is 3 years old and does not have a passport.

Considering the fact that she will have to apply for an advanced parole, fly
to Bangkok and do the paperwork for the child ... Does anybody think we
can do this in time? ie expiration date is May 20, 2003.

Does anyone have experience with what is exactly needed for children at the
US Embassy in Bangkok?

My main concern is we do NOT have the "Samnowtabianbawn" for the little
girl ... the "where-she-lives" government paperwork.

We do however have the original birth certificate.

Any insights would be greatly appreciated.

Hi All!

Well first question is did you included the child's name on the K-1 petition you
submitted to INS? Not sure of the specifics for the Bangkok embassy for a
child, but will need to have a medical exam and I assume will need at least
passport and birth certificate.

Why didn't the child come with the mother? Would have saved you a lot of
trouble.

Thanks Michael,

Yea, we put the child's name on the K-1 application. The child is doing fine
being taken care of by a sister in Thailand, but we didn't want to bring her
over just yet.

I think we will forget about the K-2 for now, and concentrate on the I-130??
later on. I realize it may be more difficult, but we want to be more
settled in here.

Pete,

Your wife does not necessarily have to go back to Bangkok to do most of the things that need to be done, unless the relatives there who are caring for her child simply can't or won't do it for her.

Anyway, the child needs a passport and all of the same materials that your wife submitted to the US embassy for her visa application must be submitted for the childs application. The tambian-bahn is not required for the visa, I don't know if the Thai government requires it to issue a passport to the child. A child that young doesn't have a Thai ID card, either. The Thai government may require written permission of some kind from the child's father before they will issue a passport, or sworn statements from your wife and witnesses that the father has done a runner and cannot be located.

The child's visa application needs to be approved within one year of the date your wife's visa was issued, i.e. by 20 May 2003 according to the information you provided, so you should have enough time as long as the passport can be obtained without problem.

You can fill out all of the visa forms from here in the US and send them over to your wife's relatives to submit to the embassy. The K2 visa will be valid for 1 year, which should give your wife plenty of 'settling in' time since she's been here 9-10 months already?

I recommend that you visit the Thai-Farang Board at <http://forums.delphiforums.com/ThaiFalang/start>. A member of the T-FB has just done what you are talking about, and he found that the consular staff in Bangkok were very helpful in getting the visa application approved before the one-year deadline.

Also visit the Thailand Packet #3 web site at <http://hometown.aol.com/nycshyguy2003/> that is maintained by a member of the T-FB. You'll find everything you need there to prepare the visa application.
