K-1 switch to K-3? Is this possible
Hi all,
My fiance and I submitted our K-1 visa application in Sept. of this year and we are so eager to be together-just like all the rest of you I'm sure, that we want to be married now.
Actually, I'm heading over to visit him this winter and we we were wanting to get married while I was there. I know that this would mean that we would have to apply for a K-3 visa though.
Is this even possible to cancel a K-1 and submit a K-3 instead? We want to be together asap and we thought this might be a faster way.
If this is possible are there any downsides to using the K-3 vs. the K-1?
I hope someone can offer some advice!
Thanks,
germerican2

germ2,
Did you really submit a K-1 visa application in September? I'll bet that you didn't....
Yes, switching from a K-1 approach to a K-3 approach can be done. I did it. Against the recommendation of my Congressman's immigration liaison and her contact at the CIS(VSC). In my circumstances I am now estimating that it will add 2-3 months to the time when my wife will enter the USA. Maybe more if the existance of the previous I-129f for fiancee slows down the review of the current I-129f for spouse (as I was told it would).

Which service center? A ROUGH estimate is that a K3 is 3 months, while a K1
is approx 6 months. Since you've already waited 2+ months, unless you're in
Nebraska (or maybe TSC is slowing down again), you probably won't gain
anything..
IMHO, anyway..
