K-1 Question

I am in the UK awaiting my interview date in London, expected at the end of July.

Can I travel to the USA for a two week holiday in mid June to visit my fiance, whilst waiting for the interview date?

I have heard that I may be refused entry, as immigration may suspect I intend to stay.

Any advice on this would be most appreciated.

(I suspect this has been posted already, but I couldn't find a thread)

Thanks,

Al

Re: K-1 Question

Have just spoken to US embassy in London.
Said it was really the immigration officers discretion, but if you have employment in the UK, bank accounts and a flat, then it shouldn't be a problem.
Just let them know you are visiting for a couple of weeks, then flying home and waiting for your interview date.

Yes, it is quite possible that you would be denied admission. Not
guaranteed, though. And fortunately, the consequences of a denial are
rather minimal in your case. The K-1 would still proceed as if nothing
had happened.

Just make sure you accept the denial of admission. In that case, you
will be treated as "withdrawing application for admission" and it is
essentially the same as if you had never tried. They don't even deny
admission in this case, because, in legal terms, you are the one who
says that you no longer want to enter the USA.

If you try and fight, they can formally deny admission (still relatively
harmless in your case), or they can put you in expedited removal
(deportation) proceedings, which would be very serious and wreak havoc
with your K-1.

But a straight denial of admission, or a withdrawal of the application,
would be harmless other than the wasted time and airfare.

It is not possible to F... anything up. The worst thing that could happen is that you would be refused, and IMO the chances of this, having taken all proof with you, is about 1%.

to add, I also answered this in marriage based visa forum
