Just got wife's AOS interview notice, Employer threatening to fire me.
Just got my wife's interview notice and since the service center is so far
away it's goin gto require me to take two days off from work. Well when I
mentioned this to my employer they threatened to fire me over it. My father
is my wife's consponsor (he blows the 125% opl requirement out of the water
by about $25,000 a year), but what are the problems that could arise out of
me being fired basically the day before the interview because of the
interview?

Until you are actually fired, you still have a job. If you lose your job
before the interview, you are obiligated to tell USCIS.
If this was my employer, I would find another job. Depending on the type
of job and where you are located, you might have some legal means to use
to stop your employer from firing you. I don't know, but some
jurisdictions have interesting employment laws.
That said, have you mentioned this to your employer before you found out
what the actual date was?

Yeppers they knew back when they hired me last month this was going to be a
issue; we didn't know the actual date till yesterday. Back then they said
"no problem, you're only part-time." Now they're saying that if I go to the
interview on the date given on the letter they'll have to "reconsider"
further employment with the company.

I talked to a couple of people today that said I'd be better off letting
them fire me; which they did threaten last night if I went to the
immigration interview. Basically their advice was this: Give BBV a copy of
the notice (with all the file information blacked out for privacy), have a
written request off in my hand, mark it on the calendar anyway, if/when they
fire me do not sign anything at all, this way it puts me in a better legal
position for unemployment benefits and any other legal action I may have to
take.
I looked over some of our forms, and it's my understanding so long as my
cosponsore (my father in this case) is making more than enough for the 125%
mark and that I can explain my unemployment then there shouldn't be a issue
on the financial side of things. Basically if I get canned, don't quit, and
explain it was because it was over immigration-- which is a major issue with
my boss- then it doesn't look AS bad as if I up and quit the week before the
interview. That being said we've got all our ducks in a row otherwise.
We've got the papers from my wife's ex-employer showing that she was
employed up till the week before we ended up actually filing for her AOS, we
found letters from her family talking about the move to Canda, we have her
old round-trip bus-ticket, the contract where I sold my land back to my
folks in preparation of us moving; so plnety of evidence that we sort of got
"stuck" here in the states. I have a joint phone bill, bank account, the
Ch. 7 court papers, disability insurance for me and my wife, our marriage
license, affidavits from my folks stating we both do live with them, letters
from family-- including my reverend uncle who married us on the fly, photos,
e-mails, e-mails from my family welcome Antoinette to the family, greeting
cards, etc, etc, etc...so I think we've got quite a bit of evidence to prove
a real marriage.
The only real thing I'm worried about is her medical. It's been over a year
since she had it done, but the service center that the interviewer may use
the old one or they might require that we come home get a new one, then make
the final ruling then.

How long did you have to wait to get the notice for the interview from Memphis after you filed the petition(I-130) for your wife?

My husband and I are going to go to Memphis as well for our
interview....on the 14th of May, he went to Nashville for his
fingerprintings and etc.. I checked on line yesterday, and first it said
between 120-180 days and now it stated his fingerprints has been
processed and we will be hearing from them soon......Is Memphis very
busy.....I was told that they only do AOS now.
so maybe it wont be as long as we think.....
congratulations on your interview......how long have you and your wife
been married......and
how long has it been since you had your medicial.......
I guess when we get the letter they will tell us
what we need to do.

We just checked the online and it stated that my husbands fingerprints
were processed, and we would hear from them either way/ whether we
needed to send them more information, or
their findings on a decision.....so I guess now we wait to hear.....I am
praying that our interview will be soon........so we can get all this
behind us......
