my fiancee was in jail last summer for selling drugs he was not the
one that did it it was his brother but he got the time i knwo it doesn
tmatter the truth jsu thte fact that i was him that was in jail he
served 4 months in jail can he still get a fiancee visa nd come to
america

Sort of hard to tell because there is no specificity in your description of the situation. In order to make a logical statement or comment to your question, it would be nice to know any of the following:

A) Am I correct in thinking that in your last sentance that you are stating that your fiancee is the one in another country and you are the future US petitioner? What country are we talking about?

B) Most people in jail claim they are not the ones who, "Did it". That is why many legal systems have judges and juries who make that determination. Innocent or guilty, I assume that your fiancee has some sort of record to indicate this. If so, have you seen it and showen it to an immigration attorney?

C) Sometimes, where there is smoke there is fire. Being that the, "Family" may have issues with drug sales I would question wether there may be more things in his/her past that he may be, "Innocent of" yet may be in the record. It is of course this record that may prevent him/her from obtaining a K1 Visa.

D) Do the two of you meet the other requirements for a K1 Visa? Such as meeting each other within two years, having the abilty to provide proof of relationship, I-134 requirements, Etc.

E) Is there something wrong with your spacebar that causes it to chop words in half and merge them with other words?

If they were convicted of selling a controlled substance last summer then they are pretty much out of luck. A waiver may be evantually obtained if the person isn't considered an aggravated felon, but the US government will want to see if the person can stay out of trouble for a few years before even considering a waiver.

I honestly doubt he will be granted a visa since was convicted of a crime and served time.
