Default ITIN and taxes, help!

Hello,
I just found out about my british spouse needing an ITIN number since
i have to file married <we were married in October> and he doesnt have
a SS#. I heard it takes like 10 weeks to get the ITIN number but tax
deadline is the 15th. What should i do? WIll i be ok as long as i send
in the paperwork before then? Please let me know! Im getting nervous
here!

Hi Erin,

I had to do the same thing with my husband. We've already applied for the ITIN but haven't recived the number yet. You can prepare your federal taxes like you normal, but you send it to the address needed to obtain the ITIN.

I contacted the IRS and was told to apply for an extension to file my taxes both for federal and state. BTW, if you owe, you still have to pay by April 15th. We applied for the ITIN late February and haven't received it yet.

Also here is a toll free number to call IRS and speak with customer service. Call 1-800-829-1040 I just called them myself at 11:15pm central time so thankfully I got the answer to a question I needed as well!!

The only reason I knew to do this was because I have a great CPA!! She works with others who've immigrated to this country so she was up on a lot of the information. This is an added plus for us because I have used her for years, long before I met my husband, but I'll definitely recommend her to other people I know here dealing with immigration.

I just don't trust many people to handle my money, lol. We actually ended up getting $1,000 more back because we included my husband on my taxes. I figured it was worth the extra wait!!

It's not too late.

you're not allowed to apply for an ITIN apart from if you're filing now i believe looking at the website, so you can still go onto his taxes tweeky. We're gonna file in the next week or 2, and i haven't got an ITIN yet.

Not to worry. I had the same situation as you did. My CPA gave me a
W-7 form which my wife had to fill out, and I included it with the tax
return to the IRS. You don't need the ITIN number before you file.
They will give you one with the W-7 and use this number for your tax
return you submitted with it.

However, your spouse has to fill out and sign this W-7 form and
provide an apostilled copy of his passport (there may be other things
he can do instead, the directions state some options), and send that
back to you. You have just a little over 2 weeks, so with a little
help from EMS (or your favorite international express mail service)
you have a sporting chance to make it!

I also included a copy of my NOA#2 of the I-130 for extra credit, even
though they didn't explicitly require this. I also made a cover letter
explaining the situation with the SSN# and that I was submitting a W-7
and wished to file a joint return with my foriegn spouse and so on.

You need to file a W-7 in conjunction with your return.

For the record, for British spouses STILL in the UK, they can go to the IRS office at the Embassy and fill out the W7 right there. My husband did that and got his ITIN number in the mail in 2 weeks.

You can get the W-7 off of the internet and it goes into great detail and like Cindy said have it notorized in the consulate. I had brought one with me to the Bogota consulate in case Angela didn't get her K-3. She got the K-3 so I will have my credit union notorize it here for me.
