INS Question ?
I have a green card and will have been in the US with it for 3 years shortly.
I am British and my wife is American.
I have 2 British children from a previous marriage.
I will apply for US citizenship after the 3 year period is up and should be able to
receive a US passport also.
Will my British children then be eligible for US passports also ?

Do they have green cards also? Do they live in the US or the UK? How old are they? As
far as I know, they will not be automaticaly eligible to become US citizens unless
they do so in their own right by spending the required period of residence in the US
and then applying for and receiving US citizenship. Only after the naturalisation
process can they (and you) become US citizens.

Do they have green cards also? Do they live in the US or the UK? How old are they? As
far as I know, they will not be automaticaly eligible to become US citizens unless
they do so in their own right by spending the required period of residence in the US
and then applying for and receiving US citizenship. Only after the naturalisation
process can they (and you) become US citizens.

A lot depends on the following:
Who has legal custody of your children? How old are they? Do they live permanently
in the US?

No they live in the UK.

No they live in the UK.

They do not have green cards and live in the UK.

Right now, your U.S. citizen wife can file Relative Petitions, Forms I-130, for your
9-year-old child and 11-year-old child, as their stepmother. A stepparent
relationship can provide eligibility for sponsorship for U.S. permanent resident
status if the relationship was created before the child's 18th birthday.
Two factors to consider: The child's mother must give permission for them to move to
the U.S. The children must reside in the U.S. most of the time to preserve their
U.S. permanent resident status, while accumulating time to qualify for U.S.
citizenship. It may not be in their best interest to spend so much time away from
their mother at this age. I also think it would be a good idea to consult a good
immigration attorney.
