Info for illegal mexicans married to US citizens

With so many illegals living here in the US, I am surprised that there
is not very much info here. or maybe this is for the legal migration.
But we all got our problems right? I talked to immigration today and
since there is proof, through arrest records, that my fiance is here
illegally then he will have a waiting period. It is 3 years for being
here illegally under a year and UP TO 10 years for being here
illegally more than a year. UP TO are the key words per immigration.
It depends on the consulates. The mexican consulate could refuse him
and once in the US , they could send him back. Lot of if's huh? But
it's worth a try. He has to return to mexico to sign his papers, but
he can wait here, illegally of course, to wait his appt in mexico,
then return to mexico for the appt. So if it takes 3 to 10 years that
is how long it takes. I tried to contact the state department to find
out examples of wait times for mexican immigrants on the k-3 visa but
I was on hold 30 minutes and they don't have a toll-free #. I will
have to use a cheap calling card on friday when I am not working to
contact them or I may try going to the consular office in atlanta on
friday...If anyone has any experience with this type of situation
please advise..thanx

Don't bother calling BCIS or Department of State! Both are notorious for
giving you bad advice; you have no more than a 50% chance of getting good
advice. If you want reliable advice, hire an attorney.
In this case, you actually got bad answers. The "UP TO" does not exist.
The ban *is* ten years, and if he returns to the US during that time, he
is, first, committing a crime (immigration fraud) and could be imprisoned
or banned for life. Second, the ten years would start over from scratch
when he leaves the US the next time.
What consular office in Atlanta are you planning to go to? There are no US
consulates inside the US, and if you are talking about a Mexican consulate
in Atlanta, they can't help you because they only know about Mexican laws.
Again, you need an attorney. You might be able to get help from a legal
aid society or from a church or charity or the like.

You should hire an attorney.
Did he enter illegally as well or did he enter on a Visa, how long
has he been in the states ?
Maybe he can use some amnesty laws... but only an attorney
would know.

That was asked before, and the issue is he has several arrests for
driving without a license, hard to claim you never been here then
Also, he will apply for a fiancee visa or for a petitiot based on
being married, the INS will ask where they met and if they come clean
then they admit he was in US, if they cook up a story they will likely
get caught and that will be even worse

That was asked before, and the issue is he has several arrests for
driving without a license, hard to claim you never been here then
Also, he will apply for a fiancee visa or for a petitiot based on

Well .. with Section 245i, if it passes, all you have to do is pay a
$1000. fine if you entered illegally or Without inspection. The 10 yr
bar would be excused and you could wait your time out here legally.
Soooo, you were illegal at first and then became legal but you are
still here in the US. The information would be extremely helpful to
all those involved. Therefore, once the bill passes, which it has in
the passed, it would extend the date at which familial status would
have had to have taken place to april 30, 2003 (as long as you could
prove that you were present in the USA on December 21, 2003 when the
bill was signed). The previous extension went up to April 30, 2001 but
the new proposal is to strike that date and insert April
20,2003...therefore making the illegals here in legal status awaiting
papers. Then I suppose this message would actually be for them at this
time.
