Word of Caution on your VWP entry/exit

DO NOT WAIT UNTIL THE 89TH OR 90TH DAY TO LEAVE THE US. If you stay as much as 1 hour over the 90th day, whether it is due to plane issues or weather issues, you then have violated the VWP and can not use it again. It is winter and while you are in an area where you don't have to worry about snow, that doesn't mean that planes will be coming in on time to your Texas airport for you to board and return to the UK.

Many people have posted about visiting during their marriage visa application, and in 20 years of being a member if BE I don't recall anyone have issues beyond an extra question or two from the immigration officer when entering the US as a visitor.

My circumstances were a bit different (my wife was living with me in London during my visa application), but I did visit the US during my visa application, and I don't recall even be asked about my visa application or plans as a future permanent resident.

And FWIW the purpose of my visit was to interview for jobs, which is something else that many self-appointed "experts" will try to persuade you is not allowed. .... What is not allowed is "working", but applying for jobs and attending interviews is totally allowed, so long as you don't actually perform any work until you have your visa in-hand.

As noted by someone else above, once you enter the US with your spouse visa you can legally work as soon as you have cleared immigration, literally right there in the airport if you have a job lined up. You don't even need a SSN (again, there are plenty of on-line experts who will try to persuade you otherwise), and I myself started work just six days after entering the US, and without an SSN - my first employer was the US subsidiary of a large multinational corporation, and the HR department didn't even bat an eyelid when I told them I had applied for an SSN, but not received it yet.

I visited multiple times using ESTA while my CR1 was processing. Never had an issue other than a cuple of extra questions about my return flight and what visa I was applying for.

I would never recommend you overstaying ESTA, it's a bad idea that can go really bad really quickly.

Thankyou for the insight Pulaski, a helpful insight! It's all starting to become a little clearer now - thanks again

Good to know! Think we're going to avoid the route of overstaying my "welcome", i appreciate the insight - thanks again.
