Hi,
My fiance is American, still living at working there. I'm Canadian,
met her a few years ago when I worked in the US. We are exploring our
options for after we get married. I personally (being Canadian) would
like us to live here but am open living/working in the US as well.
I know for Canadian immigration, we can start processing her papers
right now since we are already engaged. ie. we don't need to be
married.
For the US immigration - Does anyone know if I can start the process
now, even though we're not married yet? How long does it typically
take?
If we're going to have to wait to get married before I can apply for
US Immigration, we'd probably have to live apart until all that got
processed. Would be kind of messy, I guess we'd end up living in
Canada ;-)
If anyone has been in the same situation or knows of the rules that
can give me any advice I would really appreaciate it!
Thanks,
Kevin

Your fiancé can apply for you on a K1 Fiancé visa now. The process takes
from 4 to 6 months. You will then be able to move to the US *after*
approval. You must get married within 90 days, then file for an adjustment
of status to conditional resident. Then, you must file for another
adjustment of status during the last 90 days *prior* to the second
anniversary of the wedding, to remove the conditional status.
This is one of your options if you wish to live in the USA.
