Talking I'm a British Citizen Married to a US Citizen who is in the Military...

My husband is going to be stationed (his first post) in the US and I currently live in the UK . I was wondering if anyone has been in a similar situation to this, and what steps can I take to get out there sooner! His Tech School ends in June, so the processing will happen I guess once he is at his post. Is there anywhere I can read some more information on this . Thanks Jenny x

Many people have been in this situation. I don't believe his being in the military will speed up anything for you since he'll be stationed in the US. Your husband should submit form I-130 now, let it process, and in 8-10 months, you'll get an immigrant visa. On the day you enter the US, you'll become a US Permanent Resident (PR = green card) and can then live/work in the US. Meantime, you are free to visit the US on the VWP which will give you 90 days in the US.

We have an excellent Wiki for this: http://britishexpats.com/wiki/CR-1. Read it and all the links. All the forms are available at www.uscis.gov.

Hi and welcome to BE.

You say you want to "get out there sooner". Sooner than what?

The process you want to research on this forum is called Direct Consular Filing (DCF). If your USC husband has been living in the UK for 6+ months, he can immediately file an I-130 to London. The end result will be your Immigrant Visa (CR-1 if married less than 2 years, IR-1 if married more than 2 years). Once you have your Immigrant Visa in hand, you can move permanently to the USA.

It used to take around 5 -6 months for the DCF process, but London has slowed down now and it's taking around 8 - 10 months.

BTW, as an aside, if your husband is later posted outside of the US, you may want to look into naturalization in advance of the normally required three years of LPR status.
