I have been married for almost 4 years now. I have just realized in a
way that I have been hoodwinked. My spouse got a conditional green
card based on marriage. I want to divorce now and I know s/he has an
application pending with the INS for REMOVAL of the CONDITION BASED ON
MARRIAGE, but it has not been approved yet. Will a divorce adversely
affect or halt them getting a green card? Can they be sent back to
their home country?

When did they file the I-751? It is possible that the I-751 could be
approved before the divorce is final. Getting divorced is not going to
automatically force them back to their home country.

When did they file the I-751? It is possible that the I-751 could be
approved before the divorce is final. Getting divorced is not going to
automatically force them back to their home country.

Your question is quite strangely worded. I have no idea exactly what you are asking about. Do you have multiple "spouses"? Or is your spouse a trans-sexual undergoing the "change". Or perhaps "multiple personalities"?
The use of gender neutral and plural is weird when talking about a particular inividual situation.

Thanks Mr. F ... you beat me to it. I, too, wondered by the OP said spouse and then switched to "they" and "them".
As for his spouse's application for I-751, it will either be approved out of hand (without interview) or if the divorce is finalized before adjudication she can refile for a waiver of removal. As long as she can prove she had a bona fide marriage, she will be approved for removal. At least that is the way it has happened for other posters in the same situation, i.e. divorced.

My spouse filed the i-751 in June 2003 and I signed it without paying
attention to what I was signing. If I file for a quick divorce will it
affect the approval of the I-751?

I know you don't want to hear this, but it is possible to get
conditional status removed even if divorced. After all, since you have
been married 4 years, it shouldn't be difficult for the immigrant to
have evidence of a valid marriage. Unless you have some hard evidence
showing fraud on your spouse's part, forget about it...

I know you don't want to hear this, but it is possible to get
conditional status removed even if divorced. After all, since you have
been married 4 years, it shouldn't be difficult for the immigrant to
have evidence of a valid marriage. Unless you have some hard evidence
showing fraud on your spouse's part, forget about it...
