Our fact pattern:
1. K1/K2 admits on May 15.
2. Marriage August 15.
3. Despite numerous attempts unable to get certified copy of wedding license. Numerous excuses from clerk's office (San Diego).
4. Discovered today that marriage has been voided because of error of officiant (civil ceremony, government office) in allowing an ineligible witness (wife/fiancee son).
So, we've been unable to apply for AOS while waiting for license.
We have great wedding photos, a great honeymoon but now we don't seem to be married.
All sorts of problems with wife/stepson returning home (we're now facing a custody case there; that decision will not be enforced in Arizona due to residence pattern...deadbeat dad who deserted girl and boy has reappeared).
We obviously can't marry now (past 90 days) and adjust status or can we?
If we challenge the failure to register and get our ceremony acknowledged can we still apply for AOS and they are now almost 90 day overstays?
Any ideas?

It will be a bigger mess if you dont get legally married and she gets deported.
