Question I751 Waiver - Waiting and my 1 year extension expires soon

Any advice is much appreciated.

Here's my situation, i was still getting divorced when my greencard with CR6 (2 year limit) expired in November 8th 2007. My divorce was final in Jan 2008 and i filed the I751 (waiver) immediately afterwards, got my receipt dated 22nd Jan 08 extending my conditional resident status for 1 year. As of today my case is still pending as of today (2nd sept) at the VSC.
As you can figure out from the dates i was "out of status" for about 2 1/2 months

I have a couple of questions if anyone can help.

1. What date does the one year extension expire, the original green card date (8th Nov 07) or the receipt date on the extension letter (22nd Jan 08)?

2. What happens if the extension expires before the case has been processed? I need to travel at christmas.....

You can travel using an expired green card plus an unexpired extension letter. If the extension letter is going to expire before you leave, or while you are gone, you can go in person to your local office (via an Infopass appointment), bring proof of your need to travel, and they will most likely give you a temp I-551 stamp in your passport, which is proof of your ongoing PR status.

Common sense tells us that the one-year extension ends one year after the date on the GC. The receipt date on the letter is meaningless.
