Default I130 & I129F

Hi, my fiance & I are going over the I130 & I129F Forms while she is still
here. She leaves Feb 6th, then I am going to Ecuador to marry her on May
10th & then when I get back I will fill out the forms to get her back here
on a K3 Visa.

Anyways, looking at the forms, there are some questions I am uncertain about
& would appreciate your help.

I130: (Question 1) Name: When my fiance marries me, she is going to use her
last name & my last name hyphenated. She is Latin so its kinda similar to
what she was now. Anways on the form, do I list her name as it will be here
in the USA or her maiden name?

(Question 10) Alien Registration#. My fiance is currently here on a work
visa. Would she already have this # & where on her Visa is it located?
Also she has a social security # because she is working here. Will this
make things a lot easier when she gets back, will the # remain the same?

(Question 15) Name & Address of present employer...is this for my employer
or do they mean her employer (if she is currently in the US)?

I129F (Question 13) Have you ever filed for this fiance before? Do I put
YES since I have already sent in the I130?

Rich,

I think you jumped the gun on sending in the I-130. You have to be
married in order to file and you have not married yet. If I am
incorrect in this, I hope that someone else posts and corrects me. The
I-129F is filed as a fiance visa and it brings your fiance legally
over if your fiance is living outside of the US. I don't know much
about the K3 visa so can't answer you on that. Good luck!

At the time of filing you will have been married and therefore she
will have changed her name, so the hyphenated name is correct.

Look for an "A 1234567890" on any official documents. Yes, the S.S. #
will remain the same.

Since it's under section C "[i]nformation about your RELATIVE" her
employer is the right answer.

I think they mean actual files that have been administratively decided
previously (Y or N as to Visa), so probably no, but I am unsure.

Good Luck! (Although why don't you just marry now and AOS instead of
dealing with the visa process overseas?)

Rich,
If you don't want to get caught up in red tape the way all of us are now and waiting months on end to get our Fiancee's or Spouses here, go now and get an immigration attorney and check your options. I would not let her leave until you have married her and filed for the Adjustment of Status, that way the 2 of you do not have to seperate and the whole thing can be done here in the US. If you marry her here, you can do all the paperwork without breaking any laws. If you let her go it could be a very, very long time before she can return here to be with you. I would not let your Love get out of your sight my friend, keep her here with you and get an attorney. You are in a position we would all Love to be in, don't this opportunity slip through your fingers. Your wife to be can travel anywhere she wants to after the AOS and you can go anywhere you want to have a marraige ritual, but the opportunity to bypass all the red tape we are caught in will slip through your fingers if you let her leave now. Check your options my friend, NOW!
