Just wanted to point out that if you file AOS, there's no way that appointment can be attended, unless YOU take her to it. After filing AOS, there is a period of many months where your wife would not be able to leave the USA without abandoning her AOS.

I am just unsure of how to file this from the USA as wouldnt one of us have to be in the UK to file it when it is filed? It doesnt say on the website. All it says it that papers have to be filled at the local consulate, which there isnt one in the USA.

Adjustment of Status us your avenue. If you are not good forms, consult with that attorney you already spoke to and retain them.

This is not something you can wing if you are not sure as it can potentially result in her receiving a lifetime ban.

I have just seen it done, I assume they had a Lawyer do it or researched how to do it through their local Court system. Might involve a DNA Test?

The child's US citizenship isn't going to change. If you're going to do AOS, I recommend getting that to USCIS first, before your wife's VWP status expires. You have a LOT to do to get the AOS package put together.

The child's passport can wait, IMO.
