I-864 required for before 12/19/97

Greetings,
My name is Mohamed Abusharkh. I'm writing this email on behalf of my
father, Fayiz Abusharkh.
My father petitioned for his married son and daughter (my brother and
sister) back in July 1997 in the U.S. embassy in Kuwait where they
currently reside. My father has been living in the United States for
10 years now and is a citizen. His petition was approved and was
waiting for a visa to become available.
Recently, he received two packages, one for each case, that included
I-864 (Affidavit of Support) requiring him to complete it and send it
back to National Visa Center. My question is, since he applied for
them in July of 1997 and the law requiring I-864 was put into effect
in December 19th 1997, is he still required to complete an I-864 for
each case or is he exempt?

I doubt that anyone is exempt from the I-864 requirement. The form is
required after the date you cite to complete AOS and since this will not
occur until after the effective date of the I-864 it wouild appear to be
required.

It doesn't seem to matter when he filed the petitions. The key is when
AOS takes place.

My response was only a guess based on what I read at
www.ins.gov. You
