Default I-864?

hey, quick question.

I've a joint sponsor, and recieved the I-864 from them without w2's and copy of proof of citizenship. It'd take another couple of weeks to get these things from them and was wondering if any one would think my I-485 may still be accepted without these. the sponsor is a us citizen and more than meets the financial needs. 'm just impatient to get things off as I'm ready to send my aos away, apart from these 2 forms.... I'm thinking the w2's may not matter as I have the tax returns, but it's the copy of passport/brithcert that I wonder about.

cheers

There's no way of knowing. You can submit the AOS without their proof of citizenship, but you might receive an RFE for it, which will put your AOS on hold until you return the evidence to USCIS. You won't be considered "AOS pending" until you have a properly filed AOS package...and if USCIS notices that piece of evidence is missing, they will put your AOS on hold until you provide it.

So in my opinion, it doesn't do any good to submit it now, without something that is required, as you will just be placed on hold later anyway, still without having the proper "pending AOS" status.

But of course you CAN do that...if USCIS does not notice, and lets it go through, you can provide the missing evidence at the AOS interview, if you have one.

But, since that is a number 1 requirement, that a sponsor must be an LPR or USC, if you don't provide proof of that, I think USCIS will catch it.

Default Re: I-864?

The most commonly reported RFE is missing documentation from the Affidavit of Support.

If you do not need a Joint Sponsor, do not send in their I-864.
If you do send in a JS I-864, make it complete with all the required documentation & attachments.

An RFE of initial evidence on the I-485 also stops processing on interim benefits, specifically EAD and AP.

Sheesh, people wonder why they get problems--this is why. You are simply asking for an error.
