Default I-765 EAD Question

My husband received his EAD (I-765) receipt back on Monday, May 12th and was
instructed to call the National # on the receipt for an appointment at the
local office for his fingerprints, signature, and his picture taken. He
called and was given an appointment today (May 13th) and we went down there.
Still he has to wait the 60-90 days, but I thought I would tell this to
people who have just filed the EAD.

Since they took his fingerprints there, is it to my understanding that he
will not have to pay the $50.00 when we file the AOS which it is required?

Thanks! I still need help on the K 4 visa that I have placed on here to see
if someone can answer those questions for me too. Any immigration lawyers
willing to take a stab at the K 4 questions?

i live in houston and my wife came here on k3 on 12th march and i am getting to
diffrent answer from the ins office,ins in houston told me to bring all the
documents along with I-765 and I-485 and they will issue the ead but i called
on the ins k3 help they told me that i have to file I765 to chicago and cant
file I-485 till her I-130 gets approved. please if u can help me which statemnt
is right and if chicago to send what documents do i need to send along.

We only sent with the EAD, two photos (the side view ones), then I made
copies of his passport, his I-94, and his K 3 visa and also sent those in
with the application to the Chicago office. Plus a check for $120.00.
Nothing more.

The I-485 to my knowledge can be filed at any time and may be filed with the
I-765 or seperate. We chose to send in the I-485 seperately and have not
done so as yet, but I am happy we waited because now my husband has his
fingerprints taken by BCIS and we should not have to pay the $50.00 they
needed on the I-485 since it stated if it was taken by one of their offices,
then we would not have to pay.

So when we sent the EAD, it came back, we called for the appointment for
fingerprints, signature, and photo, and that was all that was required so
far on our part. I am sure when the EAD is approved, we will have to go
down to the local office to pick it up.

But as far as I know, you can file that I-485 after the I-765 with no
problems. But I do recall reading to make sure you get the I-485 sent in
within a year after your spouse enters because then there is no need of a
medical again since the spouse already had one prior to getting the K 3
visa.
