Default I-751 question - NSC regarding 1 year extension

Hi,

I just had a question regarding my I-751. I mailed in all of my documents
for removal of conditions back around the end of December 2002 and received
my NOA on January 6th, 2003 indicating it would take a minimum of 6 months
to process and to call if I have not heard from them within 8 months. Well,
it is way past that timeframe at this point in time and I did call to
inquire but they did not know the status of my I-751, so I decided to wait a
little longer just in case I received a letter. It is now December and I am
getting worried and not sure what to do as there are no guidelines anywhere
and I'm not really getting any definite answers, or at least feel like I
can't take them at their word.

A few days ago I called the number at the Service Center again to inquire
about what I should do and the lady there informed me that I should wait
until January 6th has passed (that being the 1 year extension they gave me
on my NOA) and then get it extended? I'm a little worried about waiting for
the 1 year to expire because then I feel like I will be "out of status".
Should I go to Chicago and get the extension now before the 1 year is up
(I'm obviously in Illinois), or should I wait like she told me. I asked her
again if I would be okay waiting for the 1 year to expire and she said I
should be just fine. I just don't know whether to believe her or not, and I
still haven't received anything advising me of the status of this
application.

Also, I just wanted to make sure that the 1 year is from the date on my NOA
(January 6, 2003), which would mean my card was extended 1 year from that
date, being January 6, 2004?

Any experiences or advice would be much appreciated, especially for those
who have already gone through this ordeal. Thanks in advance and I hope
this made sense.

Having been through all this quite recently ourselves, the NOA extends your green card for one year. It is not extension based on the issuance date of the NOA but based on the expiration date of your green card. For example, like ours expired on 8/11 and the notice was dated May 28. The card was extended until 8/11 the following year not May 28 the following year. And you will not be out of status if you don't have the stamp in your passport extending it for yet another year. Are are still in status. The I-551 stamp will be the proof not the reason why you are in status. You will need that stamp for travel and if your employer wants material proof of your status. You can take your passport and NOA to the Chicago office and get the I-551 stamp. Be sure to have other proof of identity with you when you go.

You might want to look up the timelines for the NSC for the removal of conditions. Frankly, I don't have a clue. But you can find it on www.shusterman.com. If you are way overdue, you might want to contact your congressional representative's immigration liaison and have them look into it for you.

Thank you so much for replying. I was hoping you would be the one responding
to my inquiry.

Yes, I am currently still in status because my PR card does not expire until
March 29. When the NOA said it was extended for another year, I wasn't sure,
but now that you explained it I feel a lot better. Thanks

I guess I was just confused as to why the woman at the Service Center told
me wait until my card expired and then go to get the extension as opposed to
going before it expired. She told me rather than 6-8 months, it takes about
a year, so hopefully I should hear something before March.

I am going on vacation possibly in February to the Carribbean and just
wanted to make sure I had everything in check with my paperwork before we
left, so I will probably go and get the stamp for travel before we leave.
