I-751 Question about Part 5

I am currently in the process of filling out the I-751. In section 5 it asks for
information about your children. Should we include information about the child who
was born to us this year? It seems like the question pertains to children born before
the marriage that the I130 and subsequent I751 are based on.
Also if I have Apartment lease with both our names Two joint bank accounts, tax
returns etc. Deed to a house in both our names Birth cert of our son
do I really need any additional support like affadavits? Seems like overkill but I'll
do it if I have to.
Thanks,
Tom

I'm not sure why you would think a box marked "List all your children" just wants
children from before the marriage. It wants *all* your children. If they are US
citizens like your son, just put down US citizen as the "immigration status".

Experience here has shown it can be a lottery. Those who send tonnes of evidence have
still been called for interview, those who've sent very little haven't. But I would
send the affidavits since they are listed on the form.

Actually not! The purpose of I-751 is to show that the marriage is still a valid and
a true marriage from the time you were granted conditional residence. What else could
better show it than a child born during the 2 years conditional residence?
Anyway when you fill out all the INS forms you have to think *absolute*. List all the
children even those who are not legitimate!

Re: I-751 Question about Part 5
If you had a child in this marriage, it is the best evidence that the marriage was
not a sham. So, give the info. about this child.

Re: I-751 Question about Part 5
Don't know why people assume because a couple has a child that that constitutes a valid marriage. A child is conceived in one act and that one act does not have to be based on love. But it is a kicker for the INS that the family has grown to include a new tax dependent and USC ;-)
That said, I would definitely provide them with the affidavits that they request in their checklist. It should not be viewed as overkill but as fulfilling requirements.
As Riri posted, they want evidence of the validity of your marriage from the date of your interview until the present. Anything and everything you have available that shows you are co-mingling your lives during this timespan should be included.

Re: I-751 Question about Part 5
Hi Rete and gang!
I finally found my way back to the board!
We're getting ready to send off our I-751 package to Vermont this week, and just feel
I need a little clarification on one thing. I've searched through the board and seems
this is the only topic so far that matches, sorry if it's a repeat.
Part 5...in regards to listing all children, I know this would mean all the children
born to or of the one filing for the removal of conditions. Thats cut and dried.
But, what about a step child?
I am the US Citizen, and have a son from a previous marriage. He has always lived
permanetly with me/us.
If we should list my son, what would be the correct way of doing so?
I'm probably making this more difficult than it really is, but would like a little
input from you guys.
It's good to see familair names, and see that alot of those who helped me/us in the
begining are in their final steps of the mindboggling trip with the INS.

Re: I-751 Question about Part 5
Hi Leonette
LTNS. How's the Canuck doing these days? Better than last we spoke I hope.
Believe it means you list any and all children of the couple. Those born to the two of you and those born from other unions. If I'm wrong there will be those to correct me. We don't have to file for the I-751 for another few months. You started long after us but finished way before us ;-)

Re: I-751 Question about Part 5
Thanks Rete for the quick reply!
Things are going good here. Settled down and actually enjoying life a bit. Was so
good not to have to worry or do anything for INS the past two years except maintain a
huge "evidence of a bonafide marraige" storage box!
I hope everything is going along smoothly for you and Jim. From the looks of the
processing time at VSC for the I-751, you guys may actually get done before us.
Thanks again! Leonette

Re: I-751 Question about Part 5
Actually we are both using Vermont if you are still in Pennsylvania. Actually doesn't matter much because Jim will be applying for naturalization within the timeline for spouses of US citizens and this can be done regardless of whether or not the I-751 has been approved or not.

Re: I-751 Question about Part 5
Yes, we're still in PA, same place. I don't plan on making any kind of move until
after we're done with INS.
That's true, Claude will be applying for natualization February of 2003 even if the
I-751 hasn't been approved yet.
