I-751 just back from Atlanta INS, still frustrated! Argh
HI Everyone! I posted last week about my I-751 frustrations. Long story short,
filed in 2000 at TSC, still no interview.
We lined up today in Altanta at 4:30am to finally talking to someone around
8:30am. She said that they are moving the I-751's to a different room right now, and
it will be a few weeks till they can find anyone's I-751's! She said for us to come
back in a few weeks. She said it as if its the easiest thing in the world, and we
live just down the block! We live 5 hours away in Savannah, have to kennel dogs,
pay for hotel, take off work, stand in line at wee hours in morning. Arghh!
My question in everyone who answered my last post said you could file N400 while
I-751 is pending. The lady in Atlanta said we could NOT. I was so confused, I said
are you sure? She said you can NOT even apply for N400 until you get approved with
I-751. I said, are you sure we can't at least apply for it now? She said you can't
apply until I-751 is approved.
But you all said you can, and I assume it all went ok, and also the 800 INS cust
service line a few months ago said you could file. I remember the lady on the phone
read her guidelines to me and it said if you I-751 is pending you may still apply.
But the official INS lady in Altanta said we couldn't??? Help!
Also, I said 2 years is a long time for a I-751 I heard. She said it is not, they are
backlogged from 98 and in the computer we are concidered "new" meaning 2000 people
who filed for I-751 and its in Atlanta is "new" and will be a long long time.

Advice:
Don't go back. Don't kennel the dogs. Don't take off from work. Don't go to Atlanta unless you are going there for vacation.
File for naturalization via N-400. One of the constants in dealing with INS is never believe what an underpaid, undertrained, uninformed INS employee tells you. You can file without the I-751 approval. This has been proved by others who have done this before you and done so successfully. One of which is using your Atlanta office.

I was lucky with the i-751 and tsc, I filed on jan18th 2002 and had the "conditions
removed letter around March 9th" and had the card about a week later, took about 7
weeks from start to finish. What in the world have they done with your application to
take this long, I feel for you, I really do. Take care

Thanks for your reply Sean and Lisa. I have no idea what so ever why there is such a
hold up. We triple checked before we sent in the I-751 and had everything filled out
correctly and supplied all proof they asked for.
So, you filed N400 while your I-751 was being processed?
I thought you could because the lady at INS 800# said you could, but today the lady
in person in Atlanta looked at us like we had bugs crawling out our ears when we
asked about filing N400 now. She said we can't even file it until we get approval!

Don't feel bad... I was told the same thing by an INS officer. It's scary how
many of them don't seem to know what they're talking about. Don't you believe
her! You CAN file while your I-751 is still pending, because we just did it
back in April.
We're using TSC/Atlanta too (I believe it was me Rete was talking about) - I-751
was still pending almost a YEAR at the time we sent the N-400 papers in. Barely
2 weeks after sending the papers in to TSC, Pavel had his notice to go be
fingerprinted for the N-400. He did that on April 23rd. Texas knows we had an
I-751 pending with them... I even sent in a copy of the notice and a handwritten
note with the N-400 packet explaining this. And still they proceeded normally
and sent him to be fingerprinted for naturalization.
The still pending thing was not an issue for long, since Pavel FINALLY got his
conditions removed with barely a month to go before his GC expired. He went to
Atlanta last month and got processed for the new 10 year card, and he's ALREADY
gotten the plastic card in the mail - about a month's wait! And if that's not
quick enough for you.... on the 17th of this month, he got his naturalization
interview date letter - October 9th. Seems somebody at TSC has taken their thumb
out of their butt and gotten to work.
Whole point being: You durned sure CAN file with the I-751 still pending,
because we did it. 2 years is a long time to wait for the I-751... and I thought
almost a year was bad! If I were you, I'd get about filing the N-400 as soon as
possible. Maybe they'll get you through that faster than they'd end up digging
your I-751 out of the pile in Atlanta. From what I can see, looks like they're
clicking right along at TSC!

I-751 pending with them... I even sent in a copy of the notice and a handwritten
note with the N-400 packet explaining this. And still they proceeded normally
and sent him to be fingerprinted for naturalization.
The still pending thing was not an issue for long, since Pavel FINALLY got his
conditions removed with barely a month to go before his GC expired. He went to
Atlanta last month and got processed for the new 10 year card, and he's ALREADY
gotten the plastic card in the mail - about a month's wait! And if that's not
quick enough for you.... on the 17th of this month, he got his naturalization
interview date letter - October 9th. Seems somebody at TSC has taken their thumb
out of their butt and gotten to work.
Whole point being: You durned sure CAN file with the I-751 still pending,
because we did it. 2 years is a long time to wait for the I-751... and I thought
almost a year was bad! If I were you, I'd get about filing the N-400 as soon as
possible. Maybe they'll get you through that faster than they'd end up digging
your I-751 out of the pile in Atlanta. From what I can see, looks like they're
clicking right along at TSC!

Thanks so much for your advice, we will definately file N400 now at TSC. I feel so
much better since you said you worked with TSC and Altanta and you filed N400 even
though they told you at Atlanta you couldn't.
