Default i-751 denied

i submitted the i-751 jointly in feb 2004, i got divorced in june 2004.
since the case has been pending for more than 2 years i couldnt do
anything and so i was advised. they denied my case after i didnt apper
for an interview(they sent the notice to the address on the application
and never got it) anayway, i refiled an i-751 with the waiver option, i
am having really hard time obtaining certian documents because my
ex-wife was the one keeping all the record and she left wisconsin to
missouri and i cant get a hold of her. do i have a chance, can i use
the evidence sent with the old i-751 thanx.

Any evidence which you filed with your I-751 should be in your
permanent file and CIS should consider it automatically. But just to be
sure, you should file a Freedom of Information Act on form I-639 to get
a copy of it, and then resubmit in support of your waiver.

This is not legal advice. I am not your attorney. Send any follow up
inquires to [email protected]. I do not check the newsgroup for follow
ups.

Hi:

A litle trick -- you can put in a "bare bones" I-751 -- e.g. submit with NO evidence. The old evidence will be in the file anyways.

if the decsion of termination of conditonal resident status is already
made, does this mean it is too late or refiling is an option?
