Default I-751 Acceptance questions

Hi,

My I-751 application to remove conditions was due between 7/03/02 and
10/3/02. I sent it in 9/13/02 via USPS priority mail (3-day service) with
delivery confirmation. I got a tracking number and was able to see that it
was accepted 9/16/02 at the Vermont Service Center.

I have noticed that they have not yet cashed my check, and it has been a
week since they received the app. Of course I have heard nothing from INS
that the application is missing anything or any other problems like that.

My question is: How long is a reasonable amount of time to expect them to
get around to cashing my check? I have heard of people receiving an
extension letter within a week. Should I worry at all?

Hi:

I'm an immigration lawyer practicing in Los Angeles. At least with the California Service Center, practice has varied widely. Earlier this year I had two cases, one of which received the reciept within a week, the other took 90 days. Go figure.

Do note that I-751's are slow. They are given fairly low priority because the applicant is a permanent resident and remains so during processing. That receipt is really only necessary if you need immediate travel authorization or evidence of work authoriization. [BTW, your current employer should NOT require revalidation for I-9 purposes -- it is against the law for them do so.]

Looking at our I-797 from Vermont for the I-751, mailed on May 18, received May 20 and notice date on I-797 is May 24

So you should be getting yours in a day or two.

Thanks for the insight... I understand it is a low priority thing but I was
(and still am) hoping mine goes as fast as others I read about here.
