Default I-751

Under Part 1 on the I-751 the space is labelled: "Address C/O". Whose
name should go here..the applicant or the spouse sponsor?

Also..our marriage was in July 1999 under F1 and the Conditional Green
Card was issued in April 2001. The question for anyone who knows..when
can the N-400 be filed for naturalization using the above conditions?

Unless your name is not on the mailbox and you are sharing an apartment with another family/roommate, leave that blank.

You are eligible to apply for naturalization, 90 days prior to the third anniversary of the green card. So in essence that is one year after you have filed for the removal of the conditions. Just be sure you have met the requirements in the N-400 guidelines for having been inside of the US during those three years.

Address c/o is in case you are living at an address which is not yours,
such as a family member. You would put the name of the family member
whose address it was in that blank. If the c/o is the same as your own,
then you can put either n/a in the blank or put your own name.

Hi:

You can leave blank or put in "not applicable" or "none" unless you want it sent to a different address -- say because you might be moving..

There is a reason for allowing the "c/o" address.

It should be noted that the Violence Against Women Act [passed 1993 or 94 if memory serves me correct] enacted a provision where an abused spouse could for the waiver of the joint petition even if they were still living with the abusive spouse [more common than you might think]. As part of the abused spouse provision, the law allows the abusive spouse to have the communications from INS sent to other than the home address..

If your I-751 is still pending then, you can file the N-400 in January 2004 based upon the facts you give.
