Default I-134 question

Quick background: I'm the US citizen; husband is UK citizen. We're living in England and filing for an immigrant visa for him.

Question: I've searched the wiki and forum and haven't seen this addressed. Do I HAVE to make a separate appointment in London to sign the I-134 form in front of an immigration officer. It seems like we do, but if there's an alternative -- like, for instance, we can wait to sign it until my husband's visa appointment -- then that would be great.

Sorry if this is a stupid question. But it seems ridiculous that we have to take a trip down to London just to have them watch us sign a form. It seems like I must be misunderstanding.

Huh?

Posting that is no good without much more details about your case (or did a mod split this post from another thread?).

Why an I-134? That's not a form used in the Immigrant Visa process.

Petitioning for your spouse for an IR-1/CR-1 visa is the I-130 followed by DS-230.

Yes - you're misunderstanding. You need form I-864 not I-134. When you go to London for his interview (you're going to go, right?), you can sign the form then - *if* required.

Oh, thanks for your help. Once upon a time, I had the whole process down. Now that it's been several months since we did anything with the visa process -- we took a break when we had our daughter in March -- I'm trying to refamiliarize myself with everything, and I'm getting confused. I just had a momentary panic attack about having to go back down to London, when we were just down there. So thanks for talking me down off the ledge!

What Ian says.

Further, there is no more requirement to sign the I-864 (not I-134) in front of a Consular Officer or US notary public (and when there was, I just did it at the interview).

Hi there,

I was recently in the same position as you guys (my husband is the US citizen and I'm the immigrant) and I took the I-864 form with me to the interview.

In my situation, my financial sponsor was my father in law as my husband was also in the UK with me and did not have a job to come to in the US. It was at this point we realised we did not meet the poverty guidelines on our savings alone and had to have a joint sponsor.

If you have the savings or a job to go to which meets/exceeds poverty guidelines, then you can be his sole sponsor. If not, then you will need someone else (in the US) who will complete the I-864 paperwork saying that they will support your husband financially so he does not need to claim from public funds.

If you're completing the form, sign it beforehand as my interview letter specifically said that I was not allowed to bring my spouse with me into the embassy. I hope I haven't just made things worse but we got to this point and had to rush the paperwork over from the US AFTER the interview and this delayed my visa by about a month.

If there's anything else I can help (even as a stress relief measure lol) give me a shout

For you to be admitted onto embassy property, you need to be on their list for the day - otherwise you won't get past the gate. When you fill in the DS-230 (part I), there's a question about who will be attending the interview. Be sure to list yourself in that section. And take your passport for ID.
