Default I-130 for unmarried son over 21

I am a US citizen and filed an I-130 for our son in Jan 2004.
My husband is a PR. Is it worthwhile for him to file a petition for our son?
Or do we just wait and see how it goes for now?

Is this really your son... or your stepson? If he's your son, he may be able to already claim US citizenship. If he's your stepson, did the marriage take place before or after his 18th birthday? If you want good advice, you need to provide good information.

Yes, he is our son. My husband, daughter and myself moved over here 10 years ago. Our son who was 21 at the time stayed on in Scotland to finish his university degree. I became a naturalized US citizen 3 years ago and decided to sponsor him. At the time of moving here we did not know we could sponsor him as PR's. Anyway, was wondering if it is likely to move things quicker if husband sponsors him. Or might it screw up petition already filed.

Hi:

Your husband SHOULD file for him. This will establish a priority date. If you later naturalize, the petition will then automatically convert. So its worth doing.

Also, I wish you continued good health -- but if you should die before your son immigrates, your visa petition will automatically be revoked. I've seen some sad cases with precisely this situation.

Can anyone advise me on another question? I filed the I-130 at the Nebraska office and a few weeks ago was notified that it had been sent to California. When we file the I-130 under my husband's name do we send it to Nebraska or California?
