Default I-130 is this right for me?

Hi

New here so any help would be thankful.
My dad moved to the US around 7 years ago and got married to a american lady.
Now is this correct that since im over 21 now 30 years old that i would have to fill out the I-130 form as he would sponsor me?
Also there is around a 7 year wait?
So this basicaly means while im waiting upto 7 years to acctualy be able to live with my dad i couldnt live there in anyway or seek any work without doing this ileagally?
Thank for any help.

Your DAD will file an I-130 (not you). This is the link you need to look at for more information: http://www.travel.state.gov/visa/bul...etin_4879.html

Is your dad a USC now, or is he still a Permanent Resident (has a green card)? That will make a difference in how long you will have to wait.

If your dad is a USC, your wait time looks to be around 6 years or so.

if your dad is a PR, your wait time looks to be around 8 years or so.

You are correct, while you are waiting, you can't actually LIVE in the USA. You can research other visas such as work or student visas, to see if there is any other way you can spend some time in the USA while waiting.

And if you get married, the queue gets longer!

You just have to take a long view with it, and do whatever when the time comes.
If you want to move to the US now, you need your own way there (not family relationship). For those options, please see the pinned thread in this forum called REALLY Really Read Me.

Please also read this recent thread with a story similar to your own; the explanation in it goes for you too.
