I'm a bit confused about question 22 (section C) of the I-130 form. In
bold, it says "Complete the information below if your relative is in
the United States and will apply for adjustment of status." It's
actually the second half of the question that confuses me: "If your
relative is not eligible for adjustment status, he or she will apply
for a visa abroad at the American consular post in"...
We're outside of the US, so I'm assuming the entire question doesn't
apply to us, right? Just N/A in both parts of the question? Or do I
have to enter something in the second section?
A couple other questions:
C. 15 & 16 (name and address of present employer): my wife has a job,
but it's in Germany (she's a high-school teacher). I've read elsewhere
the N/A works fine here, since they're more interested in US work. Is
this true, or should I include her employer? (A potentially mitigating
factor is that she's on mothers leave, and will be for a couple years
yet.)
C. 17 (list husband/wife & children): Besides our sons (both US
citizens through me), I'm including myself with "petitioner" in
parentheses. Is this OK?
Thanks, Walter
