Default I-130 question

My brother filed I-130 for me about 3 years back which includes me, my wife
and 2 kids.

Luckily, I got my GC thru LIFE, not because of I-130. Immigration officer
said that I have to file separately for my family.

Do you think that when Visa number is available for that I-130 which was
filed for me by my brother, I will be able to file I-485 for my wife and
kids ?

By the way, I have filed another I-130 for my wife and kids thru me
recently.

Question is, can I use first I-130 for my family ?

HAve your brother received a notice that says the petiiton doen by
your brother was approved.

Did he mean file thru LIFE or you filing I-130 for your family? You
should find out which way would be faster. I can tell you that you
filing I-130 for your family would get your family greencard faster
than waiting for the visa numbers from your brother's petition..that
is if you stay in US and mainatain your greencard..

This petiion done by your brother would take along time, say minimum
another 9 years easily before all of you (your family) can apply for
greencard - I am saying this from experience.

I am not sure whether your wife and children can apply for greencrad
if you don't but I would think so because, for example, you could have
died during that waiting period. I mean..once the petitions filed by
your brother has been approved, then it's been approved for each
member of whole family. But..logic doesn't always prevail and so ..

Beside,I think you or your brother are supposed to inform NVC office
that you already got greencard.

My main point is your brother's filing will take another 9 years
easily...
BTW, find out whether your brother has received notice letter that
says that the petition has been approved. Once approved, the NVC
center will put that in their databse and create a case number for
each of you, assigning priority dates. I would assume that your
priority date would be sometime in 2001 or 2002. Know that currently,
they are processing priority dates of May 1992 for the same category
that you are in, i.e siblings of US citizens. The way the rate of
processing has been going, you (your family) got a long way to wait,
say 8-9 years or a bit more if you wait this route..
