Default I-130: process thru Consulate or AOS??

Hi ,

My wife is in the final stages of getting her k3 in Montreal (just
sent back Packet 3).

At the same time, I am getting mail from the Visa center in NH
concerning continuing processing of her I-130, which was approved on
1/27/04.

Question : Is it more beneficial, or easier, to continue with i-130
processing thru NH and Montreal even after she comes in the country
with K3, or would it better/easier to do the AOS in Newark, NJ when
she gets here?

I dont mind going back to Montreal for her interviews and all that
....I would just prefer to process whichever way is less stressful and
more direct.

Any advice or related experiences would be most appreciated!

As always, thanks so much.

Joe

Hi Joe -

We're in a similar situation - both I-130 and I-129f applications have been approved. We plan to continue with both and either wait it out for the I-130 (CR-1) interview, or, if it takes too long, my husband will come to the states on the K3 and go back to his country for the CR-1 interview.

We're hoping that the time it takes to complete CR-1 processing (whether he's here or there) will be faster than if he's here and applies for AOS, EAD & SS #.
