I-130 petition
Hi - I am a U.S. citizen who has recently married a british citizen whose I-94
has been expired. We are about to file an I-130 and of course are a bit
frightened and confused. Does the fact that we are married now waive his
overstaying the I-94 date or should we prepare for difficulties? Any info will be
greatly appreciated. Thanks...

Overstays are forgiven for spouses of US citizens. You will also have to file
forms I-485 (change status), I-864 (promise to support alien relative, I-693
(medical), I-765 (Employment Authrization if he wants to work) G-325A (biographic
information) I-131 (Travel Authorization if he wants to travel outside the USA
while you are in process).

information) I-131 (Travel Authorization if he wants to travel outside the USA
while you are in process).
