I-130 Notice says can take 990 days? WHAT!!!!!!!!

Hey good people i filed for my wife who lives in canada at this time. I
filed for the I-130 sent my $130.00 to the texas center about 2 weeks
ago and today i received this letter please explain what it means.
Case type: I130 Immigrant petition for relative fiance (E) or orphan
Petitioner David Lockhart ( thats me)
Beneficiary (emie my wife)
Up at the top of page it sys this 1-797C,NOTICE OF ACTION
And listen what they say ( i quote)
The above application or petition has been received. It usually takes
990 to 999 days from the date of this receipt for us to process this
type of case. please notify us immediately if any of the above
information is incorrect.
It says this also:
NOTICE TYPE: RECEIPT NOTICE
AMOUNT RECEIVED $130.00
SECTIN: HUSBAND OR WIFE OF U.S. CITIZEN, 201 (B) INA
Whats this mean good people i thought the 1-130 can only take 30-90 days
they tell me over 3 years? what in the world is wrong? i sent the 1-130
form in why are they saying ths case can take 3 years to complete?

Iam from Canada and my wife is US citizen, we submit I-130 in 2002(July) received notice that BCIS received on August 9.2002 ,and March 30,2004 we got approved,which it tookabout 19 months to be approved. My original receipt says that it usually takes 500 to 600 days from the date of this receipt. I guess it depends which Service Center you are send.My application was send to Texas Service Center. I really don't know why it takes so long but that is reality. I also applied for AOS in Charlotte last year
and now have schedule for fingerprinting on April 20,2004.
I hope that information will answer your question,I think each case are different aand might takes shorter or longer perhaps.
I really don't know what section 201(b) INA really means but you will have to be patient.
Is your wife already with you?
Are you applied for K3 or K1 visa?

Perhaps you're thinking of the I-129F that is normally 60-90 days to be approved at the service centre level. Did you file that yet, now that you have the NOA for the I-130? If not, I'd get that sent in, you're probably looking at a 3-4 month wait at the bare minimum for that.

Check out this link to Matt Udall's website. He has current processing times for all of the service centers posted there. Scroll down to Texas Service Center and you will see they are processing the I-130's petition for a relative (spouse) from 4/2/02.

That's less than 990 days, but it's still a very long time.

Excuse me! He has a wife. Why would you ask him about applying for a Fiancee Visa.
Yes, David Lockhart, a/k/a Joe Peterson, that is how long it might take for the I-130 to be approved. In the interim, however, the USCIS has instituted another visa which will allow your wife to return to the US with you while this I-130 is pending. It is the K-3 visa.
Complete Form 1-29F, include all the documentation required, and send it to the Chicago address given on the form. Remember never to send originals only copies. It should take from 3 to 6 months for completion. Your wife can interview at either the US Consulate in Montreal or Vancouver.
Your might want to check out the FAQ re this type of visa.

Your posting is quite confusing. A bit of clarity might help in answering your question.
You note that the Notice of Action says you are applying under section 201(b) of the Immigration & Nationality Act -- that indicates you are a United States Citizen petitioning for your spouse.
However, you note that it will take three years to adjudicate the I-130. Inasmuch as the Service Centers are, in fact, adjudicating I-130's filed by alien permanent residents that are that old, this is a strong indication by you that you have yet to become a U.S. citizen. [In any case, although the Service Centers state they are working on "F-2A" cases filed in 2001, the category is backlogged on VISA availability to 1998].
If you are a US citiizen, there is no way of figuring out how you got either the 30-90 days OR the 3 year timeline -- the Service Centers are backlogged a year to 18 months on on "Immediate Relative" petitions.
If you are, in fact, a US Citizen, consider the K-3.

Assuming you are a US citizen, as others have said, fill out the I-129f, include the necessary documentation, as well as the NOA from the I-130 and send it to the Chicago address. This takes anywhere from 3-6 months to get approved, and your wife can interview in Canada, and then enter the US. No problemo

No my wife isnt with me NO...she is in canada. we file the I-130 and i
received the letter stating it may take up to 999 days....i thought
since we are married this cold speed the process so she could be with
me. Now this letter seems to say 999 days till i even get the first
otice of action and then file the I-129 ...what do you mean file the 29f
.i am filing for the k-3 visa PEOPLE....and i have to wait before i get
my first notice of action right? this can take 999 days right? it would
have payed my ass to marry and just keep her here then file.
